Terms of Use

These Terms of Use ("Terms") govern your use of the RestMemo Photo application ("the app") and any canvas prints you order through it. By installing or using the app, you agree to these Terms. If you do not agree, do not use the app.

The app and its canvas-print service are operated by Ihor Dzhevaha, a sole trader (empresário em nome individual) registered in Portugal (NIF: 309834783), reachable at support@restmemo.app ("we", "our").

1. What the app does

RestMemo Photo uses artificial intelligence (AI) to restore old or damaged photographs, and can optionally upscale them (UHD) or animate them (Live). You submit a photo from your device, the app sends it to a third-party AI processing partner for inference, and the result is returned to your device. You can also order a physical canvas print of a restored photo (section 6). We do not disclose the specific AI models we use, and we may change them over time to improve quality.

2. Credits and purchases

In-app operations are paid via credits. 1 credit = 1 restoration. UHD upscale = 2 credits. Live (animated) photo = 5 credits.
New users receive 1 welcome credit. Additional credits are purchased through Apple's in-app purchase system in packs of 10, 15, 20, or 30.
Credits are consumable - they are spent when you use them and do not expire. They are not transferable, refundable for cash, or convertible into anything other than operations within the app.
Credits are only deducted upon a successful result. If a restoration, upscale, or animation fails, you are not charged.
If a restoration succeeds but the result is unsatisfactory, you may regenerate it once for free, within 60 minutes of the original restoration. This one-time free regeneration is not available after a UHD upscale or Live animation.

3. RestMemo Cloud subscription

RestMemo Cloud is an auto-renewable subscription priced at $0.99/month (or the equivalent in your local currency).
It stores restored photos and originals in our encrypted cloud storage so they're available across your devices.
You may cancel at any time via iOS Settings → Apple ID → Subscriptions. The subscription remains active until the end of the current billing period.
After cancellation, cloud-stored photos remain accessible for 30 days, after which they are permanently deleted from our servers. Locally-stored photos are unaffected.

4. Acceptable use

You agree NOT to use the app to:

Process or print photos that you do not have the legal right to use.
Process photos containing illegal content, including (but not limited to) child sexual abuse material, content that incites violence, or content that violates the privacy or dignity of any person.
Attempt to reverse-engineer, decompile, or interfere with the operation of the app or our backend.
Use the app for commercial photo restoration services without prior written agreement.

We reserve the right to refuse or terminate access for any user found to violate these terms.

5. AI output disclaimer

AI restoration is a probabilistic process. The restored image is the AI's best estimate of what the original undamaged photo likely looked like - it is not a literal recovery of the original. The AI may invent details that were not present in the source. Use restored images with this understanding; do not present them as forensic or evidentiary reproductions.

6. Canvas prints (physical goods)

What it is. You can order a physical canvas print of a restored photo. Prints are sold by us and are produced and shipped by a third-party print-and-fulfillment partner.
Payment. Print orders are paid outside the app's credit system, via Stripe (Apple Pay or card). The price shown at checkout is the total payable in your local currency and includes any applicable taxes. Shipping terms are shown at checkout.
Production and delivery. Prints are made to order. Any delivery-time estimate shown in the app is indicative, not guaranteed, and depends on the destination and the fulfillment partner's carriers.
Returns and refunds. Because each canvas is personalized (printed with your photo, to your order), it is exempt from the standard 14-day right of withdrawal for distance sales under EU law (Consumer Rights Directive, Art. 16(c)). However, if your print arrives defective, damaged, or materially different from what you ordered, email support@restmemo.app within 14 days of delivery with a photo, and we will arrange a free replacement. This does not affect your statutory rights regarding faulty goods.
Your content. You confirm you have the right to print the photo you order, and you grant us and our fulfillment partner a limited license to reproduce it solely to manufacture and ship your order.

7. Intellectual property

You retain all rights to the photos you upload, the restored outputs, and any prints made from them.
We retain all rights to the app's code, design, branding, and infrastructure.
By using the app you grant us a temporary, limited license to process your photos solely for the purpose of returning a restored result to you (and, for a print order, to fulfil that order). We do not use your photos to train AI models.

8. Disclaimers and liability

The app is provided "as is". We make no warranty that it will be uninterrupted, error-free, or that any specific photo will produce an aesthetically pleasing result. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the app, including (without limitation) loss of data, emotional distress, or lost business opportunities. Our total aggregate liability shall not exceed the amount you paid for credits, subscriptions, or print orders in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

9. Changes to these Terms

If we materially change these Terms, we will update the date above and surface the change in the app at next launch. Continued use after a change indicates acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of Portugal and applicable European Union law, without regard to conflict-of-law rules. If you are a consumer, you also keep the mandatory consumer-protection rights of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform.
